SIDE) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who arrayed as sole accused apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 294(b) and 506(i) IPC and Section 4 of TNHW Act in Crime No.257/2015 and hence, seek anticipatory bail. 2.The prosecution case is that the accused under the influence of liquor, trespassed into the house of the defacto complainant and scolded her in filthy language.

3.The learned counsel for the Petitioner submitted that both the defacto complainant and Petitioner are neighbours and he has been falsely roped in this case. The learned counsel for the Petitioner also filed an affidavit of undertaking, dated 16.10.2015 stating that he will not consume liquor in future and that he will not create problem in the locality.

4.Heard the submissions of the learned Government Advocate on the submissions made by the learned counsel for the Petitioner. 5.Considering the facts and circumstances of the case and considering the fact that the petitioner has filed an affidavit of undertaking stating that he will not consume liquor and create problem in the locality in future, I am inclined to enlarge the petitioner on anticipatory bail. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his https://hcservices.ecourts.gov.in/hcservices/

appearance before the learned Judicial Magistrate, Andipatti, Theni District and on executing a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a like sum to the satisfaction to the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m until further orders. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously.

6. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready failing which, the petition for anticipatory bail stands dismissed.
