ORDER
The learned Counsel for the Petitioner submitted that the Petitioner had filed this petition seeking direction against the Respondent Police not to harass the Petitioner under the guise of an enquiry.
2. The learned Additional Public Prosecutor on instructions from the Respondents would submit that the Petitioner's son is alleged to have affair with one Malliga who is aged about 40 years and above. Due to their illicit relationship, the husband of the said Malligal had given a complaint based on which woman missing complaint had been registered Crime No.32 of 2024 by the second Respondent. Based on the complaint given by the said Malliga's husband, the Respondents had enquired the Petitioner regarding whereabouts of his son.
3. In the light of reported ruling of the Hon'ble Supreme Court in the case of Lalitha Kumari Vs. State Government of Uttar Pradesh reported in 2014 (2) SCC 1 and in the case of Arnesh Kumar Vs State of Bihar reported in 2014 (8) SCC 273, the Respondent Police is directed to issue proper summons to the Petit by specifying the date and time for their appearance and he is 2/4
prevented from harassment by the Respondent Police. Also the Petitioner is directed to co-operate with the enquiry in the light of the aforesaid ruling of the Hon'ble Supreme Court.
