ORDER : The Court Made the following order :- The petitioner, who is arrayed as the sole accused, in Crime No.446 of 2015 on the file of the respondent police, was arrested and remanded to judicial custody on 08.08.2015, for the alleged offences punishable under Section 302 of I.P.C., and hence, seeks bail.
2.According to the prosecution, when the accused and the deceased had gone to Kodaikanal, misunderstanding arose between them and therefore, on 07.08.2015, the accused stabbed the deceased with knife and caused his death.
3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely roped in this case with an ulterior motive. It is further contended that the respondent has already completed the investigation and to defend his case, he may be granted bail.
4.The learned Government Advocate (Crl.side) would submit that the major part of the investigation is over and the respondent likely to file a charge sheet in a short period.
5.Considering the facts and circumstances of the case and also considering the period of incarceration and stage of the case, this https://hcservices.ecourts.gov.in/hcservices/ Court is inclined to grant bail to the petitioner with certain
conditions. Accordingly, the petitioner is ordered to be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Mudukulathur and on further condition that the petitioner shall report before the learned Judicial Magistrate, Mudukulathur daily at 10.00 a.m, until further orders.
