ORDER

The instant writ miscellaneous petition has been filed by a retired Mazon in the Bharathidasan University, challenging the order of re-fixation of pay scale and recovery.

2. A perusal of the records reveal that the petitioner had attained the age of superannuation on 31.12.2022. Due to audit objections, the present impugned order has been passed.

3. Considering the fact that the petitioner belongs to Group - C services, this Court is inclined to pass the following interim orders: a. The first respondent is directed to forward the pension proposals on the basis of the revised scale of pay within a period of four weeks from the date of receipt of a copy of this order. The order of recovery alone is stayed; b. The eligible terminal benefits of the writ petitioner may also be released based upon the revised scale of pay; and 2/3

c. Whether the petitioner would be entitled to enhanced pay or the terminal benefits can be decided during the final hearing.

4. With the above said observations, this Writ Miscellaneous Petition stands disposed of.
