PETITION FOR ANTICIPATORY BAIL Under Sec.438 Cr.P.C PRAYER :- For anticipatory bail in cr.no.1403 of 2018 on the file of the respondent police.

ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 8(C), 20(b) (ii) (B), 29(1) of NDPS Act, 1985, in Crime No.1403 of 2018, seeks anticipatory bail.

2. Heard both sides.

3.The learned counsel appearing for the petitioner has submitted that the petitioner is an innocent and she has been falsely implicated in the above case. He further submitted that the name of the petitioner has not been found place in the FIR and only based on the confession statement given by A1, the petitioner has been falsely implicated in the above case. He further submitted that even as per the FIR, five persons were in joint possession of 1.200 kgs of ganja and the said quantity comes within the category https://hcservices.ecourts.gov.in/hcservices/

of intermediate quantity.

Hence, he prayed for grant of anticipatory bail to the petitioner.

4.Per contra, the learned Additional Public Prosecutor appearing for the respondent has submitted that totally five accused involved in the above case and on seeing the police, the petitioner escaped from the scene of occurrence. He further submitted that five accused were in joint possession of 1.200 kgs of ganja and a sum of Rs.30,500/- was recovered from A1. He further submitted that already three similar cases are pending against the petitioner. Hence, he strongly opposed this petition.

5.Taking into consideration the fact that already three similar cases are pending against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. 6.In the result, this petition is dismissed.
