CR. NO.17 OF 2015 ... RESPONDENT / COMPLAINANT For Petitioner : M/S M.PALANI RAJA Advocate For Respondent : Govt. Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who is arrayed as A1, apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 498(A), 323 and 506(i) of I.P.C., and 4 of Dowry Prohibition Act, 2001 in Crime No.17 of 2015 on the file of the respondent police and hence, seek anticipatory bail.

2.According to the de-facto complainant, she was married to the first accused about 3 years back and after delivery of the child, the accused harassed her demanding more dowry and the complaint was given before the respondent police on 11.08.2015 and thereafter, on 23.08.2015 all the accused have joined together to murder the de-facto complainant. 3.The learned counsel for the petitioner submitted that due to family dispute, a false complaint was given against the petitioner and it is further submitted that the first petitioner is working a a server in a hotel at Coimbatore and all the family members of the first accused have been falsely implicated in this case.

4.The learned Government Advocate (Crl.side) would submit that except A1, other accused were released on anticipatory bail and it is further submitted that the de-facto complainant did not appear before the Mediation Centre as per the order of this Court.

5. Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions.

6. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial

Magistrate, Thiruvadanai, Ramanathapuram District and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m., for a period of two weeks and thereafter as and when required for interrogation. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

7. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
