PRAYER: Contempt Petition is filed under Section 11 of Contempt of Courts Act, to punish the respondents for the willful disobedience and non-compliance of the order passed in W.M.P(MD)No.24431 of 2023 in W.P(MD)No.28390 of 2023, dated 01.12.2023 for committing the act of contempt of Court.

ORDER

The present contempt application has been filed alleging violation of the order of this Court made in W.M.P(MD)No.24431 of 2023 in W.P(MD)No.28390 of 2023, dated 01.12.2023, wherein this Court has granted interim stay of pay revision and the seniority list.

2. According to the learned counsel appearing for the contempt petitioner, in violation of the interim orders of this Court, the Co-operative Deputy Registrar had proceeded to grant pay revision to the senior most person.

3. It is brought to the notice of the Court that the sub applicant, namely S.Rakeshwaran has already got impleaded himself in the main writ petition.

The learned Additional Government Pleader appearing for the Co-operative Deputy Registrar has brought to the notice of the Court that order under which pay revision was granted to the sub applicant has already been recalled on 19.03.2024. The sub applicant, namely Rakeshwaran apprehends that the order of recall, dated 19.03.2024 may affect his rights on merits which are to be adjudicated by the Writ Court. Since the order of this Court has already been complied with, the contempt petition stands closed. However, the order of recall, dated 19.03.2024 will not affect any of the rights of the sub applicant, namely Rakeshwaran in the main writ petition.
