PRAYER : Transfer Civil Miscellaneous Petition is filed under Section 24 of Code of Civil Procedure, to withdraw the restitution of conjugal rights petition in I.D.O.P.No.347 of 2022 on the file of the II Additional District Judge, Trichy and to transfer the same to the family Court, Perambalur.

ORDER

The present transfer civil miscellaneous petition has been filed by the wife seeking to transfer I.D.O.P.No.347 of 2022 pending on the file of the II Additional District Court, Trichy to family Court, Perambalur. 1/4

2. According to the learned counsel for the petitioner/wife, the wife is permanently residing at Perambalur along with her parents. She finds it difficult to travel on every occasion to attend hearings in II Additional District Court, Trichy.

3. Though the respondent/husband has been served, there is no appearance either in person or through counsel.

4. Considering the above said facts, I.D.O.P.No.347 of 2022 pending on the file of the II Additional District Court, Trichy is hereby withdrawn and transferred to family Court, Perambalur.

5. With the above said direction, this Transfer Civil Miscellaneous Petition stands allowed. No costs. Consequently, connected Civil Miscellaneous Petition is closed.
