ORDER : The Court Made the following order :- The petitioner, who was arrested and remanded to judicial custody since 25.05.2018 for the offence punishable under Sections 147, 148, 341, 294(b), 302 and 506(ii) IPC and Section 4 of Tamil Nadu Prohibition of Harassment of Women Act in Cr.No.717 of 2018 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner along with other accused persons waylaid the deceased and abused in filthy language and attacked him. For which, the deceased sustained severe injury and thereafter, he dead. Hence, the complaint. 3.The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He further submitted that there was no overt act against the petitioner and he is confined more than 75 days.

4. The learned Government Advocate (Crl.side) on instructions would submit that there is a specific overt act against the petitioner and apart from this, he involved in three previous cases. Therefore, he vehemently opposed to grant bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/

5. Considering the facts and circumstances of the case and also considering the serious overt act and three previous cases pending against the petitioner, this Court is not inclined to grant bail to the petitioner. Accordingly, the Criminal Original Petition is dismissed.
