ORDER

This Criminal Original petition is filed to direct the Additional Subordinate Court, Tenkasi to expedite the trial in S.C.No.683 of 2018 within stipulated time.

2. The learned Counsel appearing for the petitioner would submit that the petitioner is the de facto complainant and the petitioner is the wife of the deceased. Based on the complaint given by the petitioner, FIR has been registered in Crime No.147 of 2012 on the file of the respondent and thereafter, the case has been taken on file in S.C.No.683 of 2018 for the offences under Section 306 of IPC, so far no trial has been commenced. Therefore, the petitioner approached this Court for speedy disposal by directing the Additional Subordinate Court, Tenkasi to complete the trial in S.C.No.683 of 2018 within stipulated time.

3. The learned Additional Public Prosecutor appearing for the respondent would submit that now the case is posted for examination of witnesses and they will cooperate to produce the witnesses within a short span of time and they 2/5

will cooperate for speedy disposal. Though the accused is not a party to this petition considering the date of occurrence (i.e.,) in the year 2012 and thereafter, the sessions case also numbered in the year 2018, still the case is pending without any examination of witnesses. Hence, this is an exceptional case for considering to issue direction for speedy disposal.

4. Therefore, it is appropriate to direct the Trial Court to complete the trial within a period of four (4) months from the date of receipt of a copy of this order.

5. With the above said observation, this Criminal Original Petition stands allowed.
