ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused No.3 apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 457 and 380 of IPC., in Crime No.162 of 2019, on the file of the respondent police and hence, seek anticipatory bail.

2.The case of the prosecution is that on 08.04.2019, when the de-facto complainant return back to his work he found the locker broke open and Rs.1,00,000/- was stolen by the petitioner. Hence, the complaint.

3.The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He would also submit that the petitioner is ready to deposit a sum of Rs.15,000/- to the credit of crime number.

4.The learned Government Advocate (Crl.Side) would submit that a sum of Rs.80,000/- was recovered from A-1.

of Rs.15,000/- to the credit of crime number, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.III, Tirunelveli, Tirunelveli District, and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall deposit a sum of Rs.15,000/- (Rupees Fifteen Thousand Only) to the credit of Crime No.162 of 2019, before the learned Judicial Magistrate No.

III, Tirunelveli, Tirunelveli District, within a period of three weeks from the date of receipt of a copy of this order and thereafter the same may be disbursed to the victim. Further, the petitioner shall appear before the respondent police daily at 10.30 a.m., for a period of two weeks and thereafter as and when required. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

6. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
