PRAYER :- for Bail in Crime No.494 of 2019 on the file of the respondent police ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Crl. Side) appearing for the respondent.
2. The petitioner was arrested and remanded to custody on 31.12.2019 for the offences under Section 392 of I.P.C. in Crime No.494 of 2019 on the file of the respondent police. Hence, she seeks bail.
3. It is a case of chain snatching. The petitioner was caught red-handed by the public themselves. The investigating officer states that it is possible to file final report within a period of one week in full and complete shape. CRL OP(MD). No.2335 of 2020 Advocate (Crl. Side) would point out that the petitioner involved in as many as 16 cases. All them are under Section 379 of I.P.C. Therefore, I am not inclined to grant bail to the petitioner.
4. Of course the petitioner's counsel would plead that the petitioner is a young woman aged about 27 years and that she is having four children. But then a person caught red-handed and who is having 16 previous cases cannot claim bail by citing her gender.
5. The respondent is directed to file the final report within a period of two weeks from the date of the receipt of a copy of this order. The Court below shall take cognizance of the case immediately. There are totally eight witnesses in this case. The investigating officer states that Jurisdictional Magistrate is heavily loaded with work and that therefore, the Court may have difficulty in fast tracking trial in this case.
6. I would therefore request the learned Judicial Magistrate to take up the case on priority basis and conclude the same as early as possible. This request is made taking note of the fact that I have denied bail to the petitioner herein.
7. With these directions, the criminal original petition stands dismissed.
