ORDER
The Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the respondents 1 and 2 to issue suitable direction to the fourth respondent not to take any further action until completion of the petitioner's appeal before the third respondent based on the petitioner's representation dated 23.01.2026, within the stipulated time that may be fixed by this Court.
2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.
3. The learned counsel for the petitioner submits that the petitioner has preferred an appeal seeking issuance of Patta before the third respondent, which is pending consideration. In the said circumstances, the fourth respondent and his
officials were came to the petitioner's house and take away a part portion of fencing and also threatened to take away the entire fencing in a week. The fourth respondent without giving any prior notice, following the legal procedure and taking steps to vacate the petitioner without following due process of law. Therefore, on 23.01.2026, the petitioner gave a detailed representation to the respondents 1 and 2 against the act of the fourth respondent and his officials. However, the respondents 1 and 2 have not issued any direction to the fourth respondent, thereby exposing the petitioner to the threat of irreparable hardship. Hence, the petitioner has been constrained to approach this Court seeking the relief stated supra.
4. The learned Additional Government Pleader appearing for the respondents would submit that the petitioner's appeal dated 01.05.2025 will be considered and disposed of on merits and in accordance with law within a time frame to be fixed by this Court.
5. Recording the aforesaid submission and without going into the merits of the matter, this Court directs the second respondent to consider the petitioner's
appeal dated 01.05.2025 and dispose of the same on merits and in accordance with law, after affording due opportunity of hearing to all the parties concerned, within a period of four weeks from the date of receipt of a copy of this order.
