Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners who apprehending arrest at the hands of the respondent police for the alleged offence under Sections 294(b), 324, 447, 379(NP), 506(ii) IPC in Cr.No.168 of 2019, on the file of the respondent police, seek anticipatory bail. 2.It is the case of the prosecution that the petitioners are said to have waylaid the defacto complainant and forcibly taken away a sum of Rs.11,000/- from him and also abused in filthy language. Hence, the complaint.

3.The learned counsel appearing for the petitioners would submit that the petitioners are innocent persons and they did not commit any offence as alleged by the prosecution. 4.The learned Government Advocate (Crl.side) appearing for the respondent police would submit that the first petitioner is having four previous cases and the second petitioner is having three previous cases. She would further submit that the amount is not recovered from the accused.

5.Considering the fact that the amount is not recovered and that the number of previous cases pending against the petitioners, this Court is not inclined to grant anticipatory bail to the petitioners. Accordingly, this Criminal Original Petition is dismissed.
