O R D E R
[Order of the Court was made by G.K.ILANTHIRAIYAN, J.] The prayer in the petition is to quash the impugned order passed by the first respondent in NO.RO/TRY/584/2025-CA dated 20.01.2026 and direct the first respondent to grant 28 days ordinary leave without police escort to the petitioner's son namely Kannan, aged about 45years, Life convict PID No. 34872 confined at Central Prison, Trichy.
2. It is the case of the petitioner that her son was convicted by the learned Sessions Judge,Mahila Court, Tiruvarur District in S.C. No.72 of 2014 on 31.08.2025 and sentenced to undergo life imprisonment for the offence under Section 302 of IPC. Aggrieved over the same, the convict has also filed an appeal before this Court in Crl.A(MD) No.597 of 2015 and the same was confirmed by this Court on 04.07.2016. The petitioner submitted an application seeking ordinary leave for a period of 28 days. After considering the request made by the petitioner, the first respondent rejected the same.
3. The learned Additional Public Prosecutor would submit that the request of the petitioner was rejected on the ground that the Probation Officer has opposed the same.
4. Taking into consideration the facts and circumstances of the case, this Court is inclined to grant 15 days ordinary leave without escort to the convict prisoner.
5. Accordingly, the impugned order passed by the first respondent is set aside and writ petition is disposed of with the following directions: (i) The respondents are directed to grant 15 days ordinary leave without escort to the convict prisoner namely, Kannan, aged about 45years, Life convict PID No. 34872 confined at Central Prison, Trichy from 05.02.2026 to 19.02.2026. The convict prisoner shall be released from the prison on 05.02.2026 at 9.00 am., (ii) He shall report back to the Superintendent of Prison, Central Jail, Trichy / second respondent, by 19.02.2026 at 6.00pm..,
(iii) The petitioner shall produce all necessary documents, along with a copy of this order, before the jail authorities, (iv) During the leave period the convict prisoner shall report before the fourth respondent daily at 5.30 pm., without fail.
6. Though the convict prisoner is eligible for 28 days ordinary leave per year, he can apply any number of time to complete the 28 days leave.
