ORDER : The Court Made the following order :- The petitioner, who is arrayed as A5 in Crime No.427 of 2015 for the offences punishable under Sections 147, 148, 365, 294(b), 323, 324, 387, 467, 506(ii) and 120(b) @ 147, 148, 365, 294(b), 323, 324, 387, 467, 506(ii), 120(b), 384 and 364(A) IPC on the file of the respondent Police, was arrested and remanded to judicial custody on 07.09.2015. He seeks bail.

2.According to the de facto complainant that he is a goldsmith and on 02.09.2015, the de facto complainant was kidnapped by the accused and demanded Rs.25 lakhs as ransom for releasing him and after receiving Rs.5 lakhs, he was released by the accused. 3.The learned counsel for the petitioner submitted that the de facto complainant is none other than the brother of the 1st accused and there are civil litigations pending between them with regard to partitioning the joint family property.

4.It is further submitted that the petitioner is a friend of the 1st accused and the 1st accused was released on bail by the Sessions Court, Tuticorin and even according to the de facto complainant, he sustained minor injury and he was discharged from the hospital.

5.The learned Government Advocate (Crl.side) appearing for the respondent submitted that the petitioner has no bad antecedent and A1 is the brother of the de facto complainant and civil litigations are pending between them.

6.Considering the facts and circumstances of the case, this Court is inclined to grant bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.II, Thoothukudi and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m., until further orders. sd/- 15/10/2015 / TRUE COPY / Sub-Assistant Registrar TO 1 THE JUDICIAL MAGISTRATE NO.II THOOTHUKUDI.
