Prayer:- Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Certiorarified Mandamus to call for the records of the impugned provisional selection list for the post of Post Graduate Assistants in Economics published on 02.01.2020 in the website of the 3rd respondent and quash the same and consequently direct the 3rd respondent to include the name of the petitioner in the provisional selection list by enlisting the SC/ST candidates, who have meritoriously ranked in the General Turn and thereafter fill up the reserve quota available in the backlog vacancies.

Challenging the impugned order of the respondent dated 02.01.2020 and for a consequential direction to the 3rd respondent to include the name of the petitioner in the provisional selection list by enlisting the SC/ST candidates, who have meritoriously ranked in the General Turn and thereafter fill up the reserve quota available in the backlog vacancies, the present writ petition has been filed.

2.The learned counsel for the petitioner would submit that pursuant to the notification No.10/2019 of the third respondent dated 12.06.2019, inviting application for 2144 posts of post graduate assistants/physical education directors Grade I, the petitioner participated in the selection process. The cut off marks for SC/ST candidates is 67.5 marks out of the total of 150 marks. The petitioner secured 69 marks. Subsequently certificate verification was held on 08.11.2019 and results were published, against which, some of the candidates approached this Court by filing writ petitions. Pursuant to the direction issued by this Court, the third respondent published a revised list on 02.01.2020, wherein, on revaluation, the petitioner scored 71 marks out of 150. However, the petitioner was not selected.

Therefore, challenging the provisional list dated 02.01.2020, the petitioner is before this Court to include his name. 4.The learned standing counsel appearing for the respondents would submit that the petitioner participated in the selection to the post of Post graduate economics in the category of SC(General), whereas the cut off mark for SC (G) category is 72.

5. Heard the learned counsel for the petitioner and the learned standing counsel for the respondents.

6. Admittedly, the petitioner participated in the selection process and scored 71 marks. It is pertinent to note that the cut off marks for Scheduled Caste (General) is 72, whereas the petitioner has scored only 71 marks and accordingly, the case of the petitioner was not considered. Hence, finding no merits in the writ petition, the writ petition is dismissed. No costs. Consequently connected Miscellaneous Petitions are closed. 14.12.2022 Index : Yes/No Internet : Yes RR
