O R D E R

(Order of the Court was made by G.K.ILANTHIRAIYAN, J.) This Habeus Corpus Petition has been filed to direct the respondents to produce the person or body of the detenue namely Michael Rani, D/o.Savarimalai aged about 38 years before this Court and set her at liberty.

2. The daughter of the petitioner got married to one Jesu and gave birth to two children. While being so from 16.01.2026 the daughter of the petitioner was found missing from the matrimonial home. Therefore the petitioner lodged complaint before the second respondent and the same has been registered in Crime No.48 of 2026 under 'woman missing'.

3. During investigation the second respondent found the detenue residing at Rajapalayam on her own volition and she was produced before this Court. She deposed that she got married with one Jesu and gave birth to two children and they are aged about 19years and 15 years respectively. While being so, she was tortured by her husband and as

such she left the matrimonial home on her own volition and now residing at Rajapalayam and she is doing some work and as such she does not want to go to her parent's home.

4. The petitioner being a mother of the detenue lodged complaint only on the instigation of the husband of the detenue . Even today the petitioner along with the husband of the detenue appeared before this Court. It is not the case that the detenue went along with another person leaving behind two children. . As of now the alleged detenue is not under illegal detention of any one.
