4.Shafi Ahamed : Respondents PRAYER: Criminal Original Petition is filed under Section 482 of Cr.P.C., to direct the respondents 1 to 3 to give an adequate police protection to the petitioner and petitioners school, situated at Door No.9, 2nd street, Nethaji Nagar, Navalpattu Main Road, Thiruverumbur, Trichy, so as to enable the petitioner to run the school peacefully and to restrain the fourth respondent or his agents from entering the school premises.

ORDER

This petition is filed to direct the respondents 1 to 3 to give an adequate police protection to the petitioner and petitioner's school.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor.

3. The learned counsel appearing for the petitioner submitted that the petitioner and the fourth respondent shared a dispute over running of a certain School, in concerning which, the petitioner has laid a suit in O.S.No.722 of 2017. The petitioner complains that he faces threat to his life, limb, liberty and right to property. https://hcservices.ecourts.gov.in/hcservices/

4. The learned counsel appearing for the fourth respondent submitted that the above said suit relates to the property dispute and not regarding the Management of running the School. He also added that the fourth respondent does not pose any threat to the petitioner's life, limb and liberty.

5. The learned Additional Public Prosecutor submitted that the complaint preferred by the petitioner is pending.

6. So far as the civil rights over the School / Management / property are concerned, the parties necessarily have to work out their remedies before the Civil Court. So far as the threat of the petitioner's life, limb and liberty is concerned, the learned counsel appearing for the fourth respondent has already made a statement that he does not pose any threat. The said statement of the learned counsel appearing for the fourth respondent is recorded.

7. In view of the above, nothing survives for the present in this Criminal Original Petition. Accordingly, this Criminal Original Petition is closed.
