RESPONDENT / COMPLAINANT For Petitioner : M/S M.SARAVANAN Advocate For Respondent : M/S.S.Prabha Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who is arrayed as A3 apprehends arrest at the hands of the respondent police for the alleged offences punishable under sections 420 and 423 of IPC, in Crime No.10 of 2014 on the file of the respondent police and hence, seeks anticipatory bail.

2.The case of the prosecution is that A1 and A2, who have no right over the property in Survey No.15/5A sold the same to A3 by a sale deed, registered as document No.577/2013.

3.The learned counsel for the petitioner submitted that the petitioner is an innocent and she has not committed any offence as alleged by the prosecution. The learned counsel further submitted that A1 and A2 were already granted anticipatory bail by this court in Crl.O.P(MD)No.6073 of 2014, dated 10.07.2014 and the petitioner/A3 was granted anticipatory bail by the Principal Sessions Judge, Tuticorin in Crl.M.P.No.3235 of 2014, dated 11.12.2014. However, the petitioner did not receive the order copy and therefore, she could not furnish the sureties within the stipulated time. The learned counsel further submitted that the petitioner is ready to abide by any condition that may be imposed by this court for extension of time to furnish sureties before the court concerned. 4.The learned Government Advocate (Criminal side) appearing for the respondent submitted that the case was registered in the year 2014 and major part of the investigation is over.

Sessions Judge, Tuticorin made in Crl.M.P.No.3235 of 2014, dated 11.12.2014 from the date on which, the order copy made ready, on condition that the petitioner shall pay a sum of Rs.10,000/- [Rupees Ten thousand only] to M/s.Rajaji Home For Aged, Old Natham Road, Madurai- 625 014, within a period of one week and also directed to produce the receipt before the lower court, failing which this order shall stand cancelled automatically without further reference to this court. The petitioner is also directed to appear before the respondent police as and when required for interrogation.

6.With the above observation, this criminal original petition is disposed of.
