RESPONDENT/COMPLAINANT Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to modify the order dated 06.03.2017 passed in Crl.O.P.(MD).No. 2399 of 2017 by this Honourable Court Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.S.
ROYCE IMMANUEL, Advocate for the petitioner and of MRS.S.PRABHA, Government Advocate (criminal side), on behalf of the Respondent the court made the following order:- The petitioner has come up with this petition seeking to modify the condition imposed by this Court in the order dated 06.03.2017 in Crl.O.P.(MD).No.2399 of 2017.
2.The learned counsel for the petitioner/A2 submitted that this Court has granted anticipatory bail to the petitioner by order dated 06.03.2017 imposing one of the conditions to deposit a sum of Rs.15,000/- to the credit of Crime No.29 of 2017. He would further submit that the petitioner is a poor farmer by profession and he could not mobilise Rs.15,000/- so as to deposit the same in Crime No.29 of 2017 as directed by this Court. Even according to the prosecution, the total amount alleged to have been damaged is only Rs.15,000/-. The petitioner is arrayed as A2 in this case and there are other accused also. Hence, the amount directed to be deposited may be reduced.
3.The learned Government Advocate appearing for the respondent has no objection for the same.

4.In view of the above, the condition imposed by this Court in the order dated 06.03.2017, directing the petitioner/A2 to deposit a sum of Rs.15,000/- to the credit of Crime No.29 of 2017 alone is modified to the effect that the petitioner shall deposit a sum of Rs.5,000/- to the credit of Crime No.29 of 2017 on the file of the respondent Police before the learned Judicial Magistrate, Tenkasi. In other respects, the said order is confirmed. However, the time limit granted by this Court to surrender before the Court below is extended by ten days from the date on which the order copy made ready.
