O R D E R

Mr.R.M.Anbunithi, learned Government Advocate (Criminal Side) takes notice for the respondents 1 & 2. Since the prayer is to consider the representation of the petitioner dated 21.11.2024, this Court is inclined to pass orders without issuing notice to the other private respondents 3 to 5.

2. The learned counsel appearing for the petitioner would submit that he has a property in Pudukottai Town, Mettupatti Village and he has been raising construction in that place and the arrayed private respondents 3 to 5 have attempted to restrain him from raising any construction, alleging that the property is 'vari poramboke'. But, he had already sent a representation to the District Collector and Tahsildar, who already inspected the property and found that there is no encroachment in the 'vari poramboke'. However, the private respondents 3 to 5 are still causing disturbance to the petitioner. Therefore, he sent a representation to the 2nd respondent, but they have not considered the same. Hence, he prayed to issue a direction to the respondents 1 and 2 to the consider the Page No. 2 of 4

representation of the petitioner.

The learned Additional Public Prosecutor (Criminal Side) appearing for the respondents 1 and 2 would submit that based on the representation given by the petitioner, they made an enquiry; but, the petitioner himself did not cooperate for the enquiry. However, they will conduct enquiry and dispose the representation of the petitioner as early as possible.

4. Considering the above said submissions and the undertaking given by the learned Government Advocate, the 2nd respondent is directed to dispose of the representation of the petitioner dated 21.11.2024 within a period of four weeks from the date of a receipt of a copy of this order and the petitioner is also directed to cooperate for the enquiry.

5. With the above said observations and directions, this writ petition is disposed of. No costs.
