ORDER : The Court made the following order :- The 2nd petitioner, who was arrested and remanded to judicial custody on 11.01.2026 for the offences punishable under Section 194(3) of BNSS @ Section 80 BNS, 2023 in Crime No.5 of 2026 on the file of the respondent Police seeks bail.

2. The case of the prosecution is that the 2nd petitioner and other accused are said to have demanded additional dowry from the defacto complainant and also harassed her, due to which she committed suicide. Hence, the complaint.

The learned Government Advocate (Crl. side) submitted that the accused Nos.3 and 4 have already been released on bail by this Court vide order, dated 02.02.2026 in the said Crl.O.P(MD).No.1823 of 2026. He would further submit that investigation of the case is pending and hence, he opposed for grant of bail to the petitioner.

4. Taking into consideration of the facts and circumstances of the 2/5

case and that the co-accused have already been released on bail and also considering the period of incarceration suffered by the 2nd petitioner, this Court is inclined to grant bail to the 2nd petitioner, subject to the following conditions:

Accordingly, the 2nd petitioner is ordered to be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties, each for a like sum to the satisfaction of the Additional Mahila Judge (Magisterial level), Thanjavur and on further conditions that :- [a] the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity.

[b] the 2nd petitioner shall report before respondent Police daily at 10.30 am until further orders; [c] the 2nd petitioner shall not abscond either during investigation or trial.

[d] the 2nd petitioner shall not tamper with evidence or 3/5

witness either during investigation or trial. [e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the 2nd petitioner in accordance with law as if the conditions have been imposed and the 2nd petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560]. [f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 BNS.
