ORDER : The Court Made the following order :- The petitioner, who arrayed as sole accused apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 506(ii) r/w Section 4 of Tamil Nadu Exorbitant Interest Act in Crime No.535/2015 and hence, seek anticipatory bail.

2.According to the defacto complainant, that he borrowed Rs.10 lakhs from the accused by hypothecating certain documents and he was paying interest for the past three years.Disputing the same, accused is demanding original of R.C.Book of his vehicle and original documents relating to his immovable property. 3.The learned counsel for the Petitioner submitted that the transaction between the accused and the defacto complainant is purely civil in nature and after registration of the case, dispute between the accused and the defacto complainant has been settled amicably and it was also reduced into writing. The learned counsel for the Petitioner has also produced a copy of the memo of understanding.

4.Heard the learned Government Advocate(Crl.Side) on the submissions made by the learned counsel for the Petitioner. 5.Considering the facts and circumstances of the case and considering the fact that the dispute is settled between the parties, I am inclined to enlarge the petitioner on anticipatory https://hcservices.ecourts.gov.in/hcservices/

bail. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.I, Dindigul and on executing a bond for a sum of Rs.10,000/- (Rupees ten thousand only) to the satisfaction to the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously.

6. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready failing which, the petition for anticipatory bail stands dismissed.
