PRAYER: Criminal Original Petition is filed under Section 482 of the Code of Criminal Procedure to direct the respondents herein to provide adequate police protection for the celebration of Maha Shivarathiri festival which is scheduled to be held on 17.02.2015 and 18.02.2015 relating to the temple namely Sri.Vannimaram Sangaiah Kovil located at Mudukkankulam Village, Kariapatti Taluk, Virudhunagar District based on the representation dated 02.02.2015.

This Criminal Original Petition is filed for a direction to the respondents to provide adequate police protection for the celebration of Maha Shivarathiri festival which is scheduled to be held on 17.02.2015 and 18.02.2015 relating to the temple namely Sri.Vannimaram Sangaiah Kovil located at Mudukkankulam Village, Kariapatti Taluk, Virudhunagar District based on the representation dated 02.02.2015.
2. Heard the learned counsel for the petitioner, learned Government Advocate (Crl.side) and the learned counsel for the intervenor.
3. Both the counsel agreed that in suits in O.S.Nos.196 of 2007 and 252 of 2007, compromise has been entered into, wherein it had been agreed that both the parties would jointly partake in worshiping activities at the temple. The learned counsel for the petitioner informs of a complaint having been preferred by the petitioner, since the temple hundial was broken and collections had been taken away. The learned counsel for the intervenor would submit that the claims of the petitioner of being the trustee of the temple etc., are false.

4. Without going into the merits of claim of either side, this Court directs the respondents to give police protection towards conduct of Maha Shivarathiri festival.
5. As the learned counsel for the intervenor expressing certain reservations regards the third respondent, this Court requires the second respondent to appoint appropriate personnel to carry out the celebration of Maha Shivarathiri festival which is scheduled to be held on 17.02.2015 and 18.02.2015, by affording police protection to the Sri.Vannimaram Sangaiah Kovil located at Mudukkankulam Village, Kariapatti Taluk, Virudhunagar District.
