PETITION FOR BAIL Under Sec. 439 Cr.P.C.
ORDER : The Court Made the following order :- The petitioner in Crl.O.P.(MD).No.20216 of 2015, who is arrayed as accused No.7 in Crime No.136 of 2015 on the file of the respondent police, was arrested on 03.05.2015 for the alleged offences punishable under Sections 147, 148, 341, 323, 324 and 307 of I.P.C., and in Crl.O.P. (MD).No.20217 of 2015 , who is arrayed as accused No.4 in Crime No.137 of 2015 on the file of the respondent police, was arrested on 03.05.2015 for the alleged offences punishable under Sections 147, 148, 294(b), 324 and 307 of I.P.C., and hence, seeks bail.
2. The learned counsel for the petitioner submitted that the petitioner is innocent and he has been in judicial custody from 03.05.2015.
3. The learned Government Advocate (Crl.side) submitted that the petitioner is history sheeter and he is having six previous cases to his credit and the injured has been discharged from the hospital.
4. However, considering the fact that the petitioner has been in judicial custody from 03.05.2015, this Court is inclined to grant bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.VI, Madurai and on further condition that the petitioner shall reside at Villupuram https://hcservices.ecourts.gov.in/hcservices/
and appear before the Villupuram Town Police Station twice a day at 10.00 a.m. and 5.00 p.m. until further orders.
