Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, calling for records relating to first respondent in Na.Ka.Aa3/12327/2019 dated 25.01.2021 and quash the same and consequently forbearing the respondents 4 and 5 from in any way erecting the High Tension Electric Tower and or interfering with the peaceful possession and enjoyment of the property comprised in Survey Nos.84/B1, 84/A and 84/B2 situated at Nedungur Village, Pugalur Taluk, Karur District without following the procedure prescribed under the Indian Telegraphic Act, 1882 and the Electricity Act, 2003.

ORDER

Heard the learned counsel for the writ petitioner. 2.The petitioner challenges the order passed by the District Collector, Karur under Section 16 of the Indian Telegraph Act, 1885. 3.The learned counsel for the writ petitioner reiterated all the contentions set out in the affidavit filed in support of the writ petition.

4.I am however unable to grant any relief to the petitioner for the simple reason that the impugned order is pursuant to the direction given by the Hon'ble Division Bench in W.A.(MD)Nos.970, 1906 and 1908 of 2020, dated 20.01.2021. The Hon'ble Division Bench in paragraph 15 of its order had specifically directed the District Collector to accord appropriate permission to enable the work to be completed within a period of one week. Therefore, the District Collector, Karur, merely complied with the direction issued by the Hon'ble Division Bench. Therefore, it is not open to the petitioner to question the correctness of the order granted by the District Collector before me. I find no ground to interfere. The writ petition is dismissed at the admission stage itself. No costs. Consequently, connected miscellaneous petitions are closed.
