Side) IN BOTH THE PETITIONS PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners, who are arrayed as accused Nos.6, 7 and 4, apprehend arrest at the hands of the respondent police for the alleged offence punishable under Section 302 of I.P.C., in Crime No.227 of 2015 on the file of the respondent police and hence, seek anticipatory bail.
2. The case of the prosecution is that due to civil dispute, the accused persons have murdered one Ganesan and based on the complaint of his wife Uma Maheswari, the defacto complainant a case has been registered for the offence under Section 302 I.P.C.
3. The learned counsel for the petitioners submitted that petitioners in Crl.O.P.(MD) No.20223 of 2015 are wives of A2 and A3 respectively and the petitioner in Crl.O.P.(MD) No.20526 of 2015 is the son of A3, who is studying in Alagappa University, Karaikudi and they have not committed the offence and there is no specific overtact attributed to the petitioners.
4. The learned Government Advocate (Crl.side) submitted that coaccused were arrested and they are still in custody.
5. Considering the facts and circumstances of the case and also considering the fact that the petitioners in Crl.O.P.(MD) No.20223 of 2015 are wives of A2 and A3 respectively and the petitioner in Crl.O.P. https://hcservices.ecourts.gov.in/hcservices/
(MD) No.20526 of 2015 is the son of A3, who is studying in Alagappa University, Karaikudi, this Court is inclined to grant anticipatory bail to the petitioners with certain conditions. Accordingly, the petitioners are ordered to be released on bail in the event of their arrest or on their appearance before the learned Judicial Magistrate, Aruppukkottai, and on their executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and the petitioners in Crl.O.P.(MD) No.20223 of 2015 shall appear before the respondent police daily at 10.00 a.m. until further orders and the petitioner in Crl.O.P.(MD) No.20526 of 2015 shall appear before the respondent police every Sunday at 10.00 a.m. until further orders. The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.
6. The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy is made ready, failing which, the petition for anticipatory bail stands dismissed. sd/- 23/11/2015 / TRUE COPY / Sub-Assistant Registrar (C.S.)
