ORDER

This Petition has been filed by the petitioner praying to modify the bail condition No.8(c) imposed by this Court in the order made in Crl.O.P.(MD).No.20128 of 2024, 1/3

dated 13.12.2024.

2. Today, Mr.SMA.Jinnah, learned counsel appearing for the petitioner, Mr.K.Sanjai Gandhi, learned Government Advocate (Criminal Side) appearing for the respondent and Mr.D.Malaichamy, learned counsel appearing for the defacto complainant are before the Court.

3. Mr.SMA.Jinnah, learned counsel appearing for the petitioner filed a memo stating that the petitioner has received the documents listed as Serial Nos.1 to 16 mentioned in the memo.

4. Mr.D.Malaichamy, learned counsel appearing for the defacto complainant submits that the defacto complainant has no objection to record the memo except Paragraph No.4, which reads as follows:

"4. It is submitted that however the defacto complainant failed to produce a document relating to the land belongs to the petitioner situated in Aruppukottai Kaatubava North Street, which is in the house where the defacto complainant resides and she stated before this Hon'ble Court that if she found the abovesaid document she will produce the same to the petitioner."

5. Considering the facts and circumstances of the case, this Court does not incline to record Paragraph No.4 of the memo. It is up to the petitioner to work out his remedy, if any, before the competent Civil Court. Apart from Paragraph No.4, the rest of the memo is recorded.
