ORDER : The Court made the following order :- The petitioner /Accused No.1, apprehending arrest at the hands of the 1/4

respondent police for the alleged offence punishable under Sections 406 and 420 of IPC in Crime No.273 of 2023, on the file of the respondent police, seek anticipatory bail.

2. The case of the prosecution is that the defacto complainant lodged a complaint stating that the first accused / petitioner made a paper publication inviting the abroad job aspirants for the purpose of arrangement of jobs in abroad. On the basis of the said advertisement and believing the words of the petitioner, the defacto complainant transferred money to her account on various dates. Totally, Rs.1,40,000/- was transferred. Later, she defaulted. The defacto complainant approached the petitioner but he did not respond properly.

3. Learned counsel for the petitioner submitted that the conditional order to deposit a sum of Rs.1,00,000/- by the petitioner, by order dated 14.02.2024 by this Court, was complied. He has also produced a receipt to that effect.

4. In view of the above said development, this Court is inclined to grant relief to the petitioner.

5. Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail in the event of arrest or on his appearance, before the learned Judicial Magistrate, (*)Bodinaickkanur, on condition that the petitioners shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two 2/4

sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the trial Court daily at 10.30 a.m., until further orders and cooperate to complete the investigation. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

6. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed. sd/- 23/02/2024 (*)Amended as per Order of the Court dt.13/03/2024 in Crl.MP(MD).3136 of 2024 in Crl.OP(MD)No.2257 of 2024 BY MDIJ.
