ORDER

This Criminal Original Petition has been filed praying to quash the proceedings in C.C.No.416 of 2014 on the file of the learned Judicial Magistrate, Srivaikundam.

2. on a complaint given by the 2nd respondent/defacto complainant, the first respondent after investigation has filed charge sheet for offences under Sections 341, 294(b), 323 and 506(ii) of I.P.C. Such case is now pending in C.C.No.416 of 2014 on the file of the learned Judicial Magistrate, Srivaikundam.

3. The parties are present before this Court and they are identified by the respective learned counsels and both the parties have filed a joint compromise memo stating that the matter in issue between them, has been amicably resolved and therefore, the parties are not willing to prosecute the case.

4. The Court has also heard the learned counsel appearing on either side and perused the materials available on record.

5. Given the nature of offences, this Court accepts the compromise.

6. In the result, the Criminal Original Petition is allowed and the proceedings in C.C.No.416 of 2014 on the file of the learned Judicial Magistrate, Srivaikundam. are hereby quashed. The memo of compromise shall form part of the records.
