PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, praying, to direct the learned Fast Track Mahila Court, Kanyakumari at Nagercoil to dispose of the Criminal Appeal No.17 of 2020 preferred against CC.No.54 of 2015 within a stipulated time as framed by this Court. O R D E R

The learned Counsel for the Petitioner submits that this Criminal Original Petition is filed seeking direction to the Fast Track Mahila Court, Kanyakumari at Nagercoil to dispose of Crl.A.No.17 of 2020. It is his submission that the Petitioner is P.W1 in the case and is the complainant in CC.No.54 of 2015 on the file of the learned Judicial Magistrate No.I, Nagercoil. After full trial, the case ended in conviction. Aggrieved by the judgment passed in CC.No.54 of 2015, the accused had preferred Crl.A.No. 17 of 2020 on the file of the Fast Track Mahila Court, Kanyakumari at Nagercoil.

2.When the case came up for hearing on 09.02.2024, this Court had sought remarks from the learned Sessions Judge, Fast Track Court, Nagercoil. Today (27.02.2024), the remarks had been received from the learned Sessions Judge, Fast Track Court, Nagercoil. 3.As per the remarks offered by the learned Sessions Judge, Fast Track Court, Nagercoil, the appeal mentioned by the Petitioner herein is of 2/5

the year 2020. The pendency of the year wise appeal cases as on 31.01.2024 is as under:- Year Pending as on 31.01.2024 Total 3/5

4.Considering the request of the Petitioner, who had been convicted by the learned Judicial Magistrate No.1, Nagercoil, the learned Sessions Judge, Fast Track Court, Nagercoil, is directed to dispose of the appeal on a priority basis within the reasonable period of 3 months from the date of receipt of a copy of this order or from the date of uploading the copy of this order in the official Website of this Court.

With the above directions, this Criminal Original Petition is disposed of.
