ORDER

(Order of the Court was made by N.SATHISH KUMAR, J.) The petitioner has filed this writ petition challenging the impugned order issued by the 4th respondent in Na.Ka.7461/2024/A1 dated 31.12.2025 and also seeking for a consequential direction, directing 1st respondent to issue patta in the name of the petitioner for the land in S.No.416/1 situated at Vellanur Village, Kulathur Taluk, Pudukkottai District, within the time frame fixed by this Court.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. On a perusal of the impugned order, it is seen that the impugned order is only to inform petitioner of the date of eviction. The petitioner has already filed a Writ Petition before this Court in W.P. (MD)No.9383 of 2025, challenging the eviction order passed under the Tamil Nadu Land Encroachment Act, 1905. This Court while allowing the Writ Petition, directed the appellate authority to dispose of the appeal filed by the petitioner. It now appears that the appeal filed by the petitioner is also over. Therefore, based on the earlier eviction order, the Tahsildar has sent a communication, which has been challenged in this Writ Petition. We are of the view that such a challenge is nothing, but futile exercise.

4. It is the submission of the learned counsel for the petitioner that the petitioner has been permitted to construct a house and she was given a license to put up a building. In this regard, the petitioner has already filed a suit in O.S.No.76 of 2023, on the file of the District Munsif Court, Keeranur, Pudukkottai, wherein, the respondents have not even filed any written statement.

5. We have perused the copy of the plaint in O.S.No.76 of 2023 also. In the said suit, the petitioner sought only a bare injunction and not even sought a declaration to assert her rights.

6. In view of the above, we de not find any merit in this Writ Petition and the same is liable to be dismissed. Accordingly, this Writ Petition is dismissed. It is open to the petitioner to file an appropriate application seeking declaration as per law in the pending suit. There shall be no order as to costs. Consequently, connected miscellaneous petitions are closed.
