.. Respondents Prayer: Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Mandamus, directing the respondents to

allow to run the petitioner's industry M/s.Rhino Scaff Industries Pvt. Ltd., situated at Sipcot Industrial Complex, Manaparai,Trichy District as regularly without any hindrance, by considering the petitioner's representation dated 28.01.2025.

ORDER

A mandamus has been sought for by the petitioner to permit the respondents to allow the petitioner-Industry to continue its operation.

The petitioner would submit that a communication was sent to all the allottees including the petitioner to shutdown their operations from 28th January, 2025 to 3rd February, 2025, in view of the in pending arrangements for the National Jambore Event, that is, scheduled to be conducted in the SIPCOT Industrial Park, Manaparai.

It is the case of the petitioner that if the petitioner is required to shutdown, they would not be able to honour their commitments to the suppliers, which would lead to unnecessary litigations and would also not only affect the current orders, but would also affect the future orders. In such an event, he would seek a direction to the respondents to permit the operation of the petitioner.

It is submitted by the learned Government Advocate appearing on behalf of the first respondent that pursuant to the request made by the petitioner to the District Collector, the petitioner's unit had been permitted to function even today. He would further submit that in the event, if this Court is to pass an order permitting the petitioner to run the Industry, they should not cause any inconvenience for the event that is being conducted at the SIPCOT Industrial Park, Manaparai and they should also ensure that the workers in their establishment are also instructed to maintain tranquillity during the event.

5. I have considered the rival submissions made by the learned counsel on either side.

6. Industries are being permitted for uplifting the economical and social welfare of the country. In such an event, for conducting an event at SIPCOT Industrial Park, there can be no direction to closedown the Industry as otherwise, it will not only have an impact on the economy, but would also affect the employees and the promised supplies to be made by an Industry to its customers.

7. In such view of the matter, I am inclined to direct the respondents to permit the operation of the petitioner-Industry. However, the petitioner shall ensure that the operation of the Industry shall not have any interference with the event that is being conducted at the SIPCOT Industrial Park, Manaparai.

8. With the aforesaid direction, this Writ Petition stands disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
