PRAYER in Crl.O.P.(MD).No.7213/2019:- To modify the condition of the anticipatory bail order dated 10.04.2019 imposed upon the petitioner by the Principal Sessions Judge, Trichy in Cr.M.P.No.1702 of 2019.

PRAYER in Crl.M.P.(MD).NO.4643 of 2019:- To extend the time to furnish sureties in Cr.M.P.No.1702 of 2019 by the Principal Sessions Judge, Trichy, dated 10.04.2019. ORDER : The Court made the following common order :- Crl.O.P.(MD).No.7213 of 2019 has been filed by the accused to modify the condition with regard to depositing a sum of Rs.1,00,000/- imposed by the learned Principal Sessions Judge, Trichy in CRl.M.P.No.1702 of 2019 dated 10.04.2019. He also filed Crl.M.P.(MD).No.4643 of 2019 to extend the time to furnish the sureties in Crl.M.P.1702/2019 on the file of the Principal Sessions Judge, Trichy, as per order dated 10.04.2019. Since the petitioner has filed Crl.M.P.No.4643 of 2019 to extend the time to furnish the sureties, as per order passed by the learned Principal Sessions Judge in Crl.M.P.No.1702 of 2019, it has to be presumed that he has accepted the conditions imposed by the learned Principal Sessions Judge in that order. https://hcservices.ecourts.gov.in/hcservices/

The learned counsel for the petitioner has submitted that since the petitioner is not able to mobilize the fund of Rs.1,00,000/- within the time fixed by the Principal Sessions Judge, Trichy, he could not surrender and deposit the said amount before the concerned Judicial Magistrate within the stipulated time and hence, he requests to extend the said period to enable the petitioner to comply with the said condition. The learned Additional Public Prosecutor has not raised any serious objection for extending the time for complying with the aforesaid condition.

Taking into consideration of the aforesaid facts, the order passed by the learned Principal Sessions Judge, Trichy in Crl.M.P.No.1702 of 2019, dated 10.04.2019 is modified as follows: "The petitioner shall surrender before the concerned Judicial Magistrate within a period two weeks from the date of receipt of a copy of this order and deposit the aforesaid sum of Rs.1,00,000/- (Rupees one lakh only) before the concerned Magistrate and execute the bond as directed by the learned Principal Sessions Judge, Trichy, in the aforesaid order. He shall comply with the other conditions also."

Accordingly, Crl.O.P.(MD).No.7213 of 2019 and Crl.M.P.(MD). No.4643 of 2019 are disposed of.
