Crime No.5 of 2011 on the file of the respondent police. ORDER : The Court made the following order :- The petitioner/Accused, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 498A, 494, 406, 506(ii) of IPC and Section 4 of Dowry Prohibition Act, in C.C.No. 163 of 2014 on the file of the learned Judicial Magistrate (Additional Mahila Court) Madurai, in Crime No.5 of 2011 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the charge sheet was laid laid before the trial Court which was taken on file in C.C.No.163 of 2014 against six persons including the petitioner. On 16.08.2024, the petitioner did not appear before the trial Court. Hence, the trial Court has issued a non-bailable warrant against the petitioner.

3. The learned counsel appearing for the petitioner submits that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. Hence, he prays for grant of anticipatory bail 2/5

to the petitioner.

4. The learned Additional Public Prosecutor appearing that the petitioner has jumped bail. He further submits that a non-bailable warrant has been issued against the petitioner.

5. Considering the fact that the petitioner has jumped bail, this Court is directing the petitioner to surrender before the learned Judicial Magistrate (Additional Mahila Court) Madurai, and file a recall application. On such application, the learned Judicial Magistrate shall consider the same in accordance with law on merits on the same day.

6. With the above said directions, this Criminal Original Petition is disposed of.
