ORDER : The Court Made the following order :- The petitioner, who is the sole accused, in Crime No.352 of 2015 on the file of the respondent police, was arrested on 19.09.2015 for the alleged offence punishable under Section 302 of I.P.C., and hence, seeks bail.
2. The case of the prosecution is that due to property dispute, on 18.09.2015, the petitioner assaulted the deceased with stone on his head and poured kerosene on the body and set him ablaze and thereby caused death and the deceased is the brother of the petitioner.
3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case with an ulterior motive and he is no way connected with the crime and he is in judicial custody from 19.09.2015.
4. The learned Government Advocate (Crl.side) submitted that due to property dispute, the petitioner murdered his brother.
5. Taking into consideration the fact and the petitioner is in judicial custody from 19.09.2015, this Court is inclined to grant bail to the petitioner with certain conditions. Accordingly, the https://hcservices.ecourts.gov.in/hcservices/ petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two
sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Nilakottai and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m. until further orders.
