ORDER : The Court Made the following order :- This petition has been filed by Accused No.5 seeking bail for the alleged offence punishable under Sections 147, 148, 341, 120(b), 109, 201 and 302 of IPC r/w Sections 4 and 5 of Explosive Substances Act 1908.
2. Heard both sides.
3. The learned counsel for the petitioner has submitted that he is an innocent person and he has been falsely implicated in the above case. Hence, he prayed to grant bail to the petitioner.
4. The learned Additional Public Prosecutor appearing for the respondent police has submitted that the crime is of the year 2014 and the case is pending before the VI Additional Sessions Judge, Madurai from the year 2018. Since the petitioner not appeared before the trial Court, Non Bailable Warrant has been issued against the petitioner and thereafter the petitioner was secured and remanded to judicial custody on 13.10.2018. He further submitted that there are seven previous cases pending against the petitioner. Hence, he strongly opposed this petition.

Taking into consideration of the fact that there are seven previous cases pending against the petitioner and also considering the fact that there is no change of circumstance after the dismissal of the earlier bail petition in Crl.O.P.(MD) No.5376 of 2019, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed. 6.Taking into consideration of the fact that the petitioner is in custody from 13.10.2018, the trial Court is directed to dispose of the case in S.C.No.195 of 2018 as early as possible. sd/- 17/06/2019 / TRUE COPY / Sub-Assistant Registrar (C.S.)
