This Criminal Original Petition is filed to direct the respondent No. 1 to transfer the Investigation Crime No.10 of 2025 dated 08.09.2025 on the file of the second Respondent to some other competent investigation agency.
2. The learned counsel for the petitioner categorically submitted that even after this Court passed an order dated 25.03.2025 in Crl.O.P(MD)No.5474 of 2025, directing the second respondent to consider the petitioner's representation and take appropriate action, the second respondent outrightly chose to remain obsolete without including Sections 468 and 476 of IPC in Crime No.10 of 2025 and the investigation is proceeded in a biased manner and sought for indulgence of this Court.
3. Learned Government Advocate(Crl.side) submitted that already there is a change in investigating Officer and duly complying the order passed by this Court in Crl.O.P.(MD)No.5474 of 2025, as directed by 2/5
this Court, the offences under Sections 468 and 476 IPC has been added in the first information report and the new investigating officer is proceeding with the investigation promptly.
4. However, the learned counsel for the petitioner intervened that it is necessary to add the Section 466 as well.
5. Heard both sides and perused the materials available on record.
6. In view of the fact that already the earlier investigating officer has been replaced with a new officer, this court directs the second respondent police to look into whether Section 466 of IPC, is necessary to be added and is also directed to appraise the progress in the investigation to the first respondent on every Friday and the first respondet is directed to monitor the progress of the investigation from time to time.
