Respondents PRAYER: Criminal Original petitions have been filed under Section 528 of BNSS to direct the 4th and 5th respondents to implicate the agents of Neomax Group of companies as accused in Crime No. 03/2023 on the file of 5th respondent, by considering the List of the names of Agents, which was provided by the petitioners before the fourth and fifth respondents.

This criminal original petition has been filed by the petitioner seeking a direction to the fourth and fifth respondents to implicate the agents of Neomax Group of companies as accused in Crime No. 03 of 2023 on the file of the fifth respondent, by considering the list of the 3/7

names of agents, which was provided by the petitioners. 2.According to the petitioners, they are the investors and aggrieved parties of the Neo Max Properties Private Limited. The Neo Max Properties Private Limited and its allied companies collected huge amount across the country and failed to settle the maturity amount to the investors. Therefore, a complaint was lodged and an FIR in Crime No.3 of 2023 was registered against the said company and its allied companies. While so, the petitioners gave a list of names of the agents of the companies. But the fourth respondent have not included them as accused in this case. Therefore, this petition has been filed. 3.

The learned Additional Public Prosecutor appearing for the respondent police would submit that they already received the list of the agents and the investigation is still pending in this case and that the respondent police have already included 164 accused persons including the companies and its agents and other individuals and the list furnished by the petitioners is also under consideration. After enquiry, based on available records, they will consider the list furnished by the petitioners.

4.In view of the arguments placed by the learned Additional Public Prosecutor, it is appropriate to dispose of this petition with a direction to the fifth respondent to consider the list submitted by the petitioners, in accordance with law on merits.

5.Accordingly, the fifth respondent is directed to consider the list submitted by the petitioners on merits and in accordance with law. With the said direction, this criminal original petition is disposed of. 05.02.2025 Internet :Yes Index :Yes/No NCC :Yes/No LR 5/7
