ORDER : The Court Made the following order :- The petitioners who are arrayed as A3 and A4 in Crime No.

66 of 2014, apprehend arrest at the hands of the respondent police for an alleged offence punishable under Sections 294(b) and 506(ii) of IPC, on the file of the respondent police, seek anticipatory bail. 2.The case of the prosecution is that the 1st accused is the owner of a Heavy Earth Mover vehicle viz., Hitachi Excavator and for carrying some earth work, the de facto complainant engaged the 1st accused and gave some amount as advance. However, the 1st accused while demanding more money for doing the said earth work, a wordy quarrel arose and due to the same, the 1st accused tried to attack the de facto complainant and threatened him with dire consequences and also abused in filthy language.

3.The learned counsel for the petitioners submitted that the petitioners are an employees under the 1st accused for which they have been falsely roped in this case. It is further submitted that the accused 1 and 2 have already been granted anticipatory bail, by this Court in Crl.O.P(MD).No.19921 of 2015 on 14.10.2015. 4.Heard the learned Government Advocate (Crl.side) appearing for the respondent Police.

5.Considering the facts and circumstances of the case and also considering the fact that the co-accused were already granted anticipatory bail, this Court is inclined to grant anticipatory bail to the petitioners, with certain conditions.

Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate, Uthamapalayam, Theni District, and on each of them executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall appear before the respondent police daily at 10.00 am until further orders. The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

6. The petitioners shall appear before the concerned Court within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
