ORDER

The prayer in this writ petition is to issue a Writ of Mandamus, directing the 6th respondent to consider the representation of the petitioner by his application in Register Number PrTN241426390830 dated April 2023.

The case of the petitioner is that he married to one Devika on 10.06.2009. Till 2018, they were not blessed with any child. Even the treatment of artificial insemination in 2018 also ended in failure. Hence, the petitioner made an adoption application through online in April 2023 vide Register No.PrTN241426390830. After receipt of the said application, the petitioner also appeared before the 6th respondent and submitted that he is financially stable, physically and mentally fit, having proper housing, sufficient income and conducive family atmosphere to raise a child and provide for the child education, health and welfare. However, till date, no action is taken on the petitioner's application. Hence, this writ petition. 3.

Learned counsel for the petitioner would submit that the petitioner made application to adopt the child namely, Dev Maran. The said child was born to a mentally retarded girl due to the rape said to have occurred to the biological mother of the child and since she was mentally ill, the maternal grandparents of the 3/7

child had given the child to the petitioner and his wife. The petitioner and his wife have taken care of the said child for about four months. Since no legal adoption was made, the 4th respondent had handed over the custody of the child to the 6th respondent under whom, the child is now given care. Hence, the learned counsel would pray for expeditious disposal of the petitioner's application by the 6th respondent. 4.

Learned Special Government Pleader appearing for the respondents would submit that the petitioner's application will be disposed of on priority basis within a time frame to be fixed by this Court.

Recording the above submission and taking note of the submission of the petitioner that the child namely, Dev Maran was already under the care of the petitioner and his wife for about four months, the 6th respondent is directed to dispose of the petitioner's application in Register No.PrTN241426390830 on priority basis than any other applications, within a period of four weeks from the date of receipt of a copy of this order, subject to compliance of 4/7

all the rules and regulations for adoption.

With the above direction, the Writ Petition is disposed of. No costs.
