COMMON PRAYER: Writ Petitions filed under Article 226 of the Constitution of India seeking issuance of Writ of Mandamus directing the respondents to pay the pension taking into account of service to the petitioners from the date of Provident fund contribution received by the second respondent dated 20.12.1984, 01.04.1986 & 17.07.1981, respectively and consequently, to give all other monetary benefits to the petitioners.

ORDER

These writ petitions are filed by the petitioners seeking a direction to the respondents to pay the pension and other benefits from the date of receipt of provident fund contribution.

2.When the matter is taken up for hearing today, there is no representation on behalf of the petitioners. 3.Mr.R.Rajamohan, learned Counsel appearing for the respondents, on instructions, submitted that the petitioner in W.P.(MD)No.3234 of 2020 is no more. In view of the aforesaid submission, this writ petition stands dismissed 2/4

as abated. However, it is open to the legal heirs of the petitioner to work out their remedy in the manner known to law, if so advised.

4.Insofar as the other two writ petitions are concerned, Mr.R.Rajamohan, learned Counsel, has produced a copy of the proceedings dated 02.12.2021 and submitted that the petitioners' claim was rejected by the Department. 5.In view of the aforesaid position, W.P.(MD)Nos.2692 & 3233 of 2020 stand closed, as no further order is required to be passed. However, the respondents are directed to communicate a copy of the proceedings dated 02.12.2021 to the petitioners within a period of one week from the date of receipt of a copy of this order and the petitioners are at liberty to challenge the same, in the manner known to law, if so advised, within a further period of six weeks thereafter.
