The present writ petition has been filed seeking a writ of mandamus directing the first respondent to issue the fresh passport to the petitioner by considering his application dated 31.12.2025.
2. The learned Government Advocate (Criminal Side) appearing for the second respondent brought to the notice of the Court that the petitioner has been implicated in a criminal case in Crime No.106 of 2024 on the file of second respondent police which has culminated in filing of a charge sheet through e-filing on 05.02.2025 before the learned Judicial Magistrate Court No.II, Madurai. Due to the memo of objections raised by the concerned Court, the charge sheet has not been taken on file so far. For the past one year, the police officials have not initiated any steps to rectify the objections raised by the concerned Court.
3. In view of the fact that cognizance has not been taken so far, this Court is of the considered opinion that there is no legal impediment for the 2/4
first respondent to consider the petitioner's request for issuance of passport. Accordingly, the first respondent is directed to consider the request of the petitioner and pass appropriate orders within a period of four (4) weeks from the date of receipt of a copy of this order.
4. With the above direction, this writ petition stands disposed of. No costs.
