ORDER

This Criminal Original petition is filed to direct the respondents 2 and 3 to provide necessary police protection to the petitioner's life and limb on the basis of his representation, dated 27.01.2025.

According to the petitioner, there was a dispute between both the community people of the petitioner and the private respondents and also there is a dispute in respect of cutting trees in the Temple land belongs to the Seedevimangalam Village. Already the petitioner made a representation before the Hindu Religious and Charitable Endowment Department to conduct public auction for cutting and selling of the trees of the Temple land and also filed writ petition in W.P(MD)No.20341 of 2024 and the same is pending before this Court. Due to the vengeance with the petitioner for filing the above said writ petition, the accused person trespassed the petitioner house and assaulted the petitioner and threatened with dire consequences. Thereby, he lodged a 2/6

complaint before the third respondent on 22.01.2025. No action was taken by the third respondent and further the accused persons made life threat to the petitioner and on 22.11.2023, they threatened to withdraw the above said writ petition filed by the petitioner. Repeatedly, the fourth respondent made threats to the petitioner. Therefore, the petitioner made a representation on 27.01.2025 to the second respondent for providing necessary police protection but the same has not been considered. Hence, the petitioner approached this Court by way of filing this petition.

3. The learned Counsel appearing for the petitioner would submit that the fourth respondent is a highly influential person and he made life threat to the petitioner. Thereby, he made a complaint before the respondent police and they have not taken any action. Thereafter, the petitioner made a representation, dated 27.01.2025 and the same has not been considered by the official respondents. Hence, the petitioner filed this petition and prays for allowing this petition.

4. Considering the limited scope of this petition, notice to the fourth respondent is dispensed with.

The learned Additional Public Prosecutor appearing for the official respondents would submit that based on the complaint given by the petitioner, dated 22.01.2025, they issued CSR.No.29 of 2025 and the same is under enquiry and seeks one week time to dispose the petition. The representation of the petitioner is under consideration and will dispose the same, within a period of one week.

6. Considering the limited prayer sought for in the writ petition, it is appropriate to direct the official respondents to consider the representation of the petitioner and dispose the same in accordance with law on merits, within a period of one (1) week from the date of receipt of a copy of this order.

7. With the above said direction, this Criminal Original Petition stands disposed of.
