Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the 3rd respondent to issue patta to the petitioner's House property to an extent of 429 sq.feet in Old Door No.3A/1, New Door No.89 in Annuppanadi Old Ward No.1 A, at present Ward No.57, Old Survey Number 488/1, New Survey No.35A1, 35 A2 and the Town Survey Number is 107, Block-8 on the basis of the petitioner's representation dated 31.12.2021. O R D E R

*********** This writ petition has been filed seeking for a direction to the third respondent to issue patta in favour of the petitioner in respect of his house property measuring to an extent of 429 sq.feet in Old Door No.3A/1, New Door No.89 in Annuppanadi Old Ward No.1 A, at present Ward No.57, Old Survey Number 488/1, New Survey No.35A1, 35 A2 and the Town Survey Number is 107, Block-8, based on the petitioner's representation, dated 31.12.2021 within a time frame to be fixed by this Court.

2.It is the case of the petitioner that he applied for patta on 31.12.2021 for the aforementioned property. But, till date the same has not been issued.

3.The learned counsel for the petitioner submits that the first and second respondents have forwarded the application of the petitioner to the third respondent.

4.No prejudice would be caused to the respondents, if the petitioner's application seeking for issuance of patta for the aforementioned property, is considered on merits and in accordance with law, after hearing all the necessary parties including the second respondent.

5.For the foregoing reasons, this Court directs the third respondent to consider the petitioner's representation dated 31.12.2021, seeking for issuance of patta in his name for the aforementioned property and pass appropriate orders on merits and in accordance with law, after hearing the petitioner as well as any other necessary party, including the second respondent, within a period of twelve weeks from the date of receipt of a copy of this order.

6.With the aforesaid direction, this Writ Petition is disposed of. No costs.
