O R D E R
This writ petition is filed by the petitioners to direct the 4th and 5th respondents to attach the properties of Neomax company and its allied concerns, as identified by the petitioners in connection with the case in Crime No.03 of 2023 on the file of the 5th respondent by considering the petitioners representation dated 24.09.2024.
2. According to the petitioners, they are one of the depositors in the Neomax company and its allied concerns, and due to non-repayment of the amount, a case has been registered in Crime No. 03 of 2023 on the file of the 5th respondent and now the 5th respondent also taking steps to attach the properties of the accused. While so, the petitioners also made a representation by enclosing the list of properties belongs to the accused and its allied concerns. Therefore, the said representation of the petitioners has to be considered by the 5th respondent for attaching the properties.
3. The learned Additional Public Prosecutor (Criminal Side) appearing for the respondents would submit that already they have attached some properties of the accused and in the mean time, the Page No. 3 of 6
petitioners also being the depositors have furnished the list of properties. However, they have to verify those list and if the properties originally belongs to accused company, then they will take appropriate steps to attach properties after enquiry.
4. In view of the above said representation of the learned Additional Public Prosecutor, it is appropriate to direct the 5th respondent to consider the representation of the petitioners purely on merits and in accordance with law within fifteen [15] days from the date of this Order. Accordingly ordered.
5. With the above said direction, this Writ Petition is disposed of. No costs.
