The writ petitioner filed this Writ Petition seeking for issuance of a Writ of Mandamus directing the second respondent to grant permission to conduct the temple function of Arulmigu Sree Pottal Sudalaimada Swamy Thirukoil situated at Pungampatti, Kadayam Village, Alangulam Taluk, Tenkasi District on 10.02.2023 and 11.02.2023 by considering the petitioner's representation dated 25.01.2023.
2. Mr.E.Antony Sahaya Prabahar, learned Additional Public Prosecutor takes notice for the respondents. By consent, this writ petition is taken up for final disposal at the admission stage itself.
3. The learned counsel appearing for the writ petitioner submitted that in order to conduct function for the temple, by name, "Arulmigu Sree Pottal Sudalaimada Swamy Thirukoil" situated at Pungampatti, Kadayam Village, Alangulam Taluk, Tenkasi District on 10.02.2023 and 11.02.2023, they sought permission of the police by giving a representation dated 25.01.2023. But, the second respondent has not 2/4
considered the said representation. Since no order was passed, the writ petitioner has come before this Court for the above said relief.
4. The learned Additional Public Prosecutor appearing for the respondents would submit that since there were rival claimants, 107 Cr.P.C. proceedings were initiated.
5. Recording the submission made by the learned Additional Public Prosecutor, the Tahsildar, Tenkasi is directed to conduct a peace committee meeting in this regard and consider the claims of both the parties and decide within a period of three days from today.
6. With the above direction, this writ petition stands disposed of. No costs.
