ORDER : The Court Made the following order :- The petitioners who is arrayed as A1, in Crime No.520 of 2015 on the file of the respondent police, was arrested and remanded to judicial custody on 12.09.2015, for the alleged offences punishable under Sections 4(1)(a) and 4(1)(A) TNP Act r/w 468, 474, 471 and 489(d) of I.P.C., and hence, seeks bail.

2.The case of the prosecution is that the accused was found in possession of machines for taping the bottle cap and 15 numbers of labels for day and night brandy, orange colour powder, 750ml ammonium sulphate bottle and venila flavour 20 ml 4 bottles, plastic cane, aluminium tumbler and 3 litres of I.D arrack.

3.The learned counsel for the petitioner submitted that the petitioner is an innocent and he has been falsely implicated in this case and it is further submitted that the similarly placed co-accused was released on bail by the Sessions Court in Crl.M.P.No.3416 of 2015. 4.The learned Government Advocate (Crl.side) would submit that the petitioner is having one previous case of similar in nature and the material objects have been recovered from the petitioner. 5.However, considering the facts and circumstances of the case, this Court is inclined to grant bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.II, Thanjavur and on further condition that the petitioner https://hcservices.ecourts.gov.in/hcservices/

shall reside at Vilupuram and report before the Inspector of Police, Prohibition Enforcement Wing, daily twice a day at 10.00 a.m, and 05.00 p.m., until further orders.
