Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner who apprehends arrest at the hands of the respondent police for the alleged offence under Section 379 IPC in Cr.No.81 of 2019, on the file of the respondent police, seeks anticipatory bail.
2.It is the case of the prosecution that the petitioner and other accused are said to have cut down the palm trees, worth about Rs.16,000/-, which is belonged to the defacto complainant. Hence, the complaint.
3.The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he did not commit any offence as alleged by the prosecution.
4.The learned Government Advocate (Crl.side) appearing for the https://hcservices.ecourts.gov.in/hcservices/ respondent police would submit that the alleged amount is not recovered from the accused persons.
5.Considering the fact that the amount is not recovered from the accused persons, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
